Dragon mission ends with splashing success

The Dragon space capsule returned to Earth from the International Space Station, capping off its historic mission with a splashdown in the Pacific Ocean. NBC's Mark Barger reports.

SpaceX's Dragon cargo capsule parachuted to a picture-perfect splashdown in the Pacific Ocean today, ending the first-ever commercial mission to the International Space Station.

The gumdrop-shaped Dragon made history last week as the first U.S. craft to reach the orbital station since last year's retirement of the space shuttle fleet, and it made history today as the first commercial craft to return a shipment from orbit.

The billionaire founder of California-based SpaceX, Elon Musk, told reporters that the nine-day space station resupply mission was "like a grand slam" in baseball, and repeatedly voiced joy and surprise at how well it went.?"There are a thousand ways that it could fail, so this may sound sort of odd, but when you see it actually work, you're sort of surprised," he said.


The 14.4-foot-high (4.4-meter-high) capsule came down about 500 miles west of Baja California, within a mile of its target point, Musk said. When he saw the first pictures of the craft bobbing in the Pacific, he said his reaction was, "Welcome home, baby. ... It's like seeing your kid come home."

The demonstration flight will almost certainly earn a go-ahead for SpaceX to start space station resupply missions in earnest under the terms of a $1.6 billion contract with NASA. Alan Lindenmoyer, manager of NASA's commercial crew and cargo program, said a few more items needed to be marked off on the list of criteria, but he voiced nearly as much satisfaction about the results as Musk did.

"It is very easy to see that this satisfies, I believe, 100 percent of those criteria," he said.?

The demonstration flight began on May 22 with the Dragon's launch from Cape Canaveral Air Force Station in Florida, atop a SpaceX Falcon 9 rocket. The mission?reached its climax last Friday when astronauts used the space station's robotic arm to?pull the Dragon in to its docking port on the the station's Harmony module. On the following day, when station crew members entered the Dragon for the first time, NASA astronaut Don Pettit gushed over its new-car smell.

Over the days that followed, the station's crew unloaded a half-ton of food, equipment, experiments and other supplies?? then loaded it back up with more than 1,300 pounds (620 kilograms) of non-essential Earth-bound shipments.

What happened today
Today, astronauts reversed the process they went through last week.?The robotic arm pulled the Dragon out from its port and positioned it for release at 5:49 a.m. ET. SpaceX's craft then executed a series of engine burns to take itself out of the station's neighborhood and descend from orbit.

The final engine burn slowed the Dragon's orbital velocity by 100 meters per second (224 mph)?? enough to drop it into a fiery descent through the atmosphere.?The craft's bottom is coated with a layer of protective material called PICA-X, which SpaceX's engineers say is resilient enough to weather a return to Earth from Mars. At its peak, the heat shield had to endure temperatures in excess of 3,000 degrees Fahrenheit (1,650 degrees Celsius).

The suspense built during a few minutes of scheduled communication blackout, but eased when infrared imagery from airplanes circling the projected splashdown site showed the Dragon's parachutes opening. For some observers, the sight of the red-and-white main parachutes sprouting from the capsule sparked a flashback to the days of the Apollo moonshots.

At 11:42 a.m. ET, SpaceX's controllers confirmed that the craft made a successful splashdown.?NASA mission commentator Josh Byerly observed that the Dragon mission "ended like it began ??which is, fairly easily."

A pre-positioned flotilla of recovery ships loaded up the Dragon and will bring it back to the port of Los Angeles, near SpaceX's Mission Control in Hawthorne, Calif. Some high-value experimental payloads will be unloaded in L.A. and delivered to NASA within 48 hours, but the bulk of Dragon's cargo will be taken off after it's transported to SpaceX's test facility in MacGregor, Texas.

Over the past few years, NASA has paid out about $300 million to help SpaceX develop the Dragon and the Falcon 9 rocket. SpaceX has invested a similar amount of its own capital. This test mission should clear the way for SpaceX to start in on the $1.6 billion station resupply contract, which covers 12 flights through 2015. Musk said he expected the first full-fledged Dragon cargo run to lift off late this summer.

Another company, Virginia-based Orbital Sciences Corp., is working on an alternate commercial delivery system, but that system hasn't yet gone through flight testing.

Grand plans for NASA and SpaceX
Such deliveries are part of NASA's grand plan in the post-shuttle era to transfer space station resupply operations to commercial companies, at what is expected to be a cost far less expensive than space shuttle operations. Theoretically, that would free up money for NASA to concentrate on developing a more powerful heavy-lift rocket and a more capable Orion spacecraft for missions beyond Earth orbit ? heading toward asteroids, the moon and eventually Mars.

SpaceX and three other companies?? Blue Origin, the Boeing Co. and Sierra Nevada Corp.?? are working on spacecraft capable of transporting astronauts to and from the station, and NASA expects those ships to be available for its use as early as 2017. SpaceX's crew-carrying craft will be an upgraded version of the Dragon that was used for the current cargo mission.

Musk said Dragon 2.0 would have a thruster system capable of making near-pinpoint, helicopter-style landings. That system is due for testing later this year, and could be ready for NASA in three to five years.?Such a system would be a must-have for landings on other worlds, Musk noted.

Musk, a dot-com billionaire who made his fortune with PayPal, ?founded?SpaceX?in 2002 as part of his own grand plan to help humans get to Mars and become a "multiplanet species."

Today he noted that the company, known more formally as Space Exploration Technologies Corp., is under contract for about 40 launches, including the 12 planned Dragon cargo missions for NASA as well as commercial launches. Just this week, SpaceX announced a deal with Intelsat to put a telecom satellite into geosynchronous transfer orbit using the Falcon Heavy rocket, which is still under development. SpaceX also hopes to win some launch contracts for the Falcon Heavy from the U.S. military.

Some veteran observers of the space effort, including Apollo moonwalkers Neil Armstrong and Gene Cernan, have been critical of NASA's move toward commercialization. Cernan, for example, complained to Congress that commercial space companies "don't know what they don't know." But Musk said the Dragon mission demonstrated that "commercial spaceflight can be successful." He voiced hope that SpaceX's efforts would inspire a new generation of engineers and explorers.

"We're really at the dawn of a new age of space exploration, where there's going to be a huge amount of opportunity and a lot of exciting things happening," Musk said.

NASA Administrator Charles Bolden expressed similar sentiment in a post-splashdown statement: "This successful splashdown and the many other achievements of this mission herald a new era in U.S. commercial spaceflight. American innovation and inspiration have once again shown their great strength in the design and operation of a new generation of vehicles to carry cargo to our laboratory in space. Now more than ever we're counting on the inventiveness of American companies and American workers to make the International Space Station and other low-Earth-orbit destinations accessible to any and all who have dreams of space travel."

Sprint arranges $1 billion credit to buy Ericsson gear - Financial News

NEW YORK (Reuters) - Sprint Nextel Corp said on Tuesday it arranged a credit facility of $1 billion to buy network equipment from Ericsson for its high-speed wireless project.

Sprint, the No. 3 U.S. mobile provider that has been working to eliminate a estimated funding gap of $5 billion to $7 billion, said it entered the credit agreement, which expires in March 2017, with Deutsche Bank and a syndicate of other banks.

Sprint has been under pressure to raise financing in recent months as it committed to a $15.5 billion contract with Apple Inc for iPhones in addition to its $7 billion network project, which involves shutting down one of its two networks and upgrading the other.

With the vendor financing agreement, spokesman Scott Sloat said Sprint has "largely addressed" funding requirements it flagged last year.

Separately, Sprint also said it would pay back $1 billion of debt set to mature in the fourth quarter of 2013. After the payment, which the company plans to make on June 8, the outstanding balance on the 6.875 percent notes would be about $473 million, Sprint said.

Joe Scarborough Praises Joe Biden For Memorial Day Speech (VIDEO)

Joe Scarborough heaped more love onto Joe Biden on Tuesday's "Morning Joe," praising the vice-president's deeply personal speech over the Memorial Day weekend.

Speaking to the families of fallen troops on Friday, Biden recalled the painful loss of his first wife and baby daughter in a car accident in 1972. He recounted his grief in wake of the tragedy ? admitting that he had even pondered thoughts of suicide ? and told listeners that the darkness would someday lift.

On Tuesday, Scarborough cited someone else's description of Biden's remarks as the "heartfelt, most moving political speech" he had ever witnessed, and proceeded to praise the vice-president himself. "This is why Joe Biden is Joe Biden," he said.

"Exactly. We talk about loving him, and this is why," co-host Mika Brzezinski agreed. "We really respect his contribution to his country, because nobody could deliver the message he delivered on Friday."

Scarborough said that Biden was different from other politicians who fake empathy for grieving family members. "Here's Joe Biden doing it not for political reasons, but for very personal reasons to explain to these people I understand your pain and today as we start the Memorial Day weekend, let me talk to you about how you heal again," he said.

The MSNBC host has professed his admiration for the vice-president before. He recently praised Biden for delivering a fiery speech about his working-class roots on the campaign trail.

Spanish debt costs spiral as crisis deepens

MADRID (Reuters) - Spanish 10-year borrowing costs neared the 7 percent danger level and Bankia shares hit record lows on Monday after the government, struggling to sort out its finances, proposed putting sovereign debt into the struggling lender.

Prime Minister Mariano Rajoy pinned the blame for the rising borrowing costs - the spread over Germany reached the highest since the euro's launch - on concern about the future of the single currency. He again ruled out seeking outside aid to revive a banking sector laid low by a property boom that has long since bust.

"There are major doubts over the euro zone and that makes the risk premium for some countries very high. That's why it would be a very good idea to deliver a clear message there's no going back for the euro," Rajoy told a news conference.

"There will not be any (European) rescue for the Spanish banking system."

He gave no details of bank recapitalization plans but backed calls for the euro zone bailout fund, which will be in place from July, to be able to lend to banks direct.

Government sources told Reuters Spain may shore up Bankia with sovereign bonds in return for shares in the bank and could use this method to prop up other troubled lenders - moves which would push the country's debts above the 79.8 percent of economic output which had been expected this year.

"This method has been used by Germany and by Ireland in the past, it is perfectly valid," a government source told Reuters.

The source said the ECB had not been specifically informed of the plans to inject state bonds into Bankia. A final decision had not yet been made on which option to take.

Bankia's parent company BFA has asked for 19 billion euros ($23.8 billion) in government help, in addition to 4.5 billion the state has already pumped in to cover possible losses on repossessed property, loans and investments.

Investors increasingly believe weak banks, undermined by the collapse four years ago of a decade-long property boom, coupled with heavily indebted regions, could force Spain to seek an international bailout which the euro zone can barely afford.

LACK OF CONFIDENCE

The premium investors require to hold Spanish government bonds over German counterparts hit a euro-era high at 505 basis points, denoting a lack of confidence in Madrid's efforts to stabilize its finances and ailing banks.

Having dropped to around 4.7 percent earlier this year, helped by the ECB's creation of a glut of three-year money, 10-year borrowing costs are now approaching 6.5 percent and closing in on the 7 percent level widely seen as unsustainable.

Ireland and Portugal were frozen out of capital markets and forced to seek international bailouts soon after their yields topped 7 percent.

"If it goes on for much longer, it just adds to the burden of fiscal consolidation," said Elisabeth Afseth, analyst at Investec in London. "If a large part of that is spent on paying a premium to borrow, it just makes it so much harder."

Spain's trump card is that it has issued well over half the debt it needs to this year, in the first five months.

But that advantage is being eroded.

The government said last week its highly indebted regions faced 36 billion euros of debt refinancing bills this year, way above the previously stated 8 billion. Catalonia said it was running out of options and needed central government help.

A plan to recapitalize Bankia with Spanish government bonds, which the bank could then use as collateral to get cash from the ECB, could add to the government's refinancing problems.

Spain's Treasury insisted it would repay debt maturing without problems.

"We are in a very strong position (to meet debt maturing shortly)," said Ignacio Fernandez Palomero, deputy director of public debt at the Treasury, pointing to redemptions in July and October, when Spain has big amounts due.

Spain's central government and regions need to refinance 117.5 billion euros of debt by the end of the year, while funding a deficit worth 52 billion euros.

It has already shifted more than 55 percent of its debt issuance for the year but about half of the remaining debt maturing in 2012 will have to be repaid in the last three months of the year, making it imperative borrowing costs have been brought down by then.

THUMBS DOWN FROM MARKETS

Bankia parent BFA is set to report the biggest loss in Spain's banking history.

"The figures are much higher than any other release from any other bank," a financial source with direct knowledge of the bank's situation told Reuters.

Despite the 23.5 billion euros rescue cued up for Bankia, its shares tumbled by about 13 percent, pressuring some weaker peers. Its drastic hike in provisions to cover potential losses from repossessed property and souring consumer debt has raised the prospects that other banks may need to do the same.

A wider audit of Spain's banking system should reveal by June what capital gap other banks will need to fill.

"The events at Bankia will reinforce the view that the upcoming external review should identify a significant recapitalization need for the Spanish banking system," analysts at Nomura said in a note, putting a recapitalization of the whole sector at between 50 and 60 billion euros, with the main listed banks requiring an additional 16 billion euros.

Nomura said only BBVA, Santander and Sabadell would not need to strengthen their capital, while the government would need to clean up smaller lenders it has already propped up, such as Banco de Valencia, Novacaixagalicia and Catalunya Caixa.

"Given the current economic and political uncertainties facing the euro zone, this could see additional pressure on Spain to consider using external funds for the bank recapitalisation," Nomura said.

Amid eurozone turmoil, Germany borrows money for free

Germany sold $5.7 billion of debt today to yield 0 percent, a reflection of how much Europe's largest economy has diverged from its southern neighbors who are paying far more to borrow.

?That?s a very good result for us,? said a spokesman of Germany?s Federal Finance Agency in Frankfurt, which manages the sales. ?It is an impressive illustration of investors? search for quality.?

But the first time in history the German central bank sold two-year notes to yield zero percent is evidence of how much trouble the rest of Europe is in. The free money for Germany amount to a loss for investors after inflation. Why are bankers willing to lose money on a loan to Germany? Because it isn't Greece. Or Italy. Or Spain.

Germany is not only one of the few growing European economies but its domestic finances are rock solid, unlike its eurozone peers. Spain and Italy are paying? more than six percent to borrow, because investors fear they'll default. European bankers, worried about ending up holding worthless paper, have few good options but the Bundesbank.?

Seven percent is perceived as the threshold beyond which borrowing becomes unsustainable ? Greece, Portugal and Ireland all asked the European Union and International Monetary Fund for financial aid after their borrowing costs breached that threshold.

The zero-interest sale reflects investors' interest in "a return of their money over a return on their money,"?Rabobank rate strategist Richard McGuire told Reuters.

High interest rates are exacerbating the economic problems in southern Europe. Greece, now in its fifth year of recession, seems more and more likely to leave the eurozone. Even after negotiating a far-reaching debt reduction with private investors earlier this year, the country won?t be able to service the remaining debt. Reuters quoted two Eurogroup officials today confirming that member states are being asked to prepare individual contingency plans for the eventuality of a Greek exit.?

While Germany made its record-breaking bond sale, EU leaders prepared for yet another crisis summit. Tonight they are convening for an informal meeting in Brussels to discuss measures to stimulate economic growth in the eurozone. The meeting is seen as the first battle between German Chancellor Angela Merkel, who strictly objects to growth programs financed through additional borrowing, and the new French president, Francois Hollande, unofficial spokesman for the growing group of leaders who advocate credit-based stimulus plans.

Before the meeting, Germany?s deputy finance minister, Thomas Steffen, rejected renewed calls for the introduction of eurobonds ? debt securities issued by the eurozone as a whole which in effect would mean that Greece could borrow at the same rate as Germany.

?We would sign up for 100 percent liability for new debt in the euro area,? Steffen said in Berlin today. ?We can?t do this, we?re not strong enough economically.?

Washington women advance two boats to Grand Finals | NCAA Crew

WEST WINDSOR, N.J. ? Washington placed two boats in the Grand Finals of the NCAA Championships on Saturday, a significant achievement for the program as it seeks a return to national prominence.

The Huskies secured entries for the varsity eight and the varsity four at Saturday's semifinals on Lake Mercer's 2,000-meter course.

It is the first time since 2008 the varsity eight has reached the Grand Final of the NCAAs. The boat advanced out of a brutal semifinal grouping, which saw the Huskies paired with Michigan, Princeton, UCLA, Yale and Ohio State. Only the top three boats move on and the message UW coach Bob Ernst delivered before the race reflected its importance: Sunday matters little if you don't race at your best today.

"The game now is to get on the podium," Ernst said. "We'll see what everyone brings (on Sunday). I'm looking forward to it."

At the start of the V8 race, few teams could match the Wolverines' punishing pace. But the Huskies remained in contact with Michigan, as well as second-place Princeton. Those positions held firm until the 1,250-meter mark as the Huskies began to take seats from the Tigers, while managing to push away from UCLA. Ohio State, which won its heat on Friday, was faltering in fifth. With 250 meters to go, the Huskies thwarted a late move by the Bruins and crossed the line third overall, finishing in 6 minutes, 18.30 seconds.

Joining the Huskies in the Grand Final will be Michigan, Princeton, Virginia, California and USC. Making the Grand Final with the flagship boat was considered a critical goal coming into the race.

While the varsity's eight spot was relatively secure, the same couldn't be said for the varsity four.

Washington's time of 7:11.25 was shade in front of Harvard's (7:12.16) for the last spot in the Grand Finals.

"It's a character check. How deep are you willing to go, and how much (pain) can you tolerate?" Ernst said. "It's important to the program to see results like that."

Yankees' Girardi craves sugar cereal

OAKLAND, Calif. (AP) - Joe Girardi recalls being about 8 when a train derailed behind his grandparents' farm and left enough stray boxes of Cap'n Crunch cereal to feed him and his four siblings for a full year.

What a treat that became. The kids typically only got sugar cereal on the weekends, but this was the exception.

"It was the only year we got sugar cereals during the week," Girardi said Saturday, teasing the media that they had interrupted his morning cereal ritual.

These days, Girardi is lactose intolerant, so the New York Yankees manager often snacks on the sugary cereals sans milk during road trips considering most visiting clubhouses don't keep a lactose-free variety in the fridge.

"My mother lived on a farm when she was growing up and behind the farm was a train track," the New York Yankees manager said Saturday. "When I was a kid my mom's family still basically owned the house. A train derailed and one of the cars was full of Cap'n Crunch. We had so much Cap'n Crunch over the next year it was amazing. To this day I still like Cap'n Crunch. It's rough on the roof of your mouth."

He insists he only needs a handful to get his fix.

"Most of my cereal I put protein powder on," he said.

But he still loves to treat himself with a bowl of Cap'n Crunch, Cocoa Puffs, Lucky Charms or Honey Nut Cheerios - the latter being his choice before Saturday afternoon's middle game against the Oakland Athletics.

Girardi said he doesn't remember whether the owner of all that cereal ever came looking for the Cap'n Crunch, which his uncles packed back to the house.

"I don't know what happened. I didn't ask questions, I was like 8 years old," he said. "It was all Cap'n Crunch, the regular, no berries. We had a lot. It lasted a year in our house and there were five of us."

Victorian companies tap into Middle East automotive industry

The Victorian Government, in cooperation with the Australian Automotive Aftermarket Association, has supported Australia?s largest ever export mission to the Automechanika Middle East Trade Show, which has been underway in Dubai this week. Participation of companies from Victoria has increased by 30 per cent on last year?s delegation, further underlining the emphasis the State is putting on the Middle East Automotive Aftermarket industry.

John Butler, State Government of Victoria Commissioner to the Middle East and North Africa, said last year?s trade show saw over 70 per cent of participating companies attract new business, with even more expected this year.

?This is one of the most important automotive markets in the world,? said Mr Butler. ?We will continue to focus our efforts on developing key relationships and creating trade opportunities for Victorian companies here, just as we have done for many years now. We are confident in what we can bring to the market, and our world-class expertise, knowledge, innovation and quality products is growing in demand following a long-standing commitment to the region.?

This is the sixth year the State Government of Victoria has supported a trade delegation to Automechanika Middle East, and the twelfth year Australia has been participating in one form or another in the Emirate?s annual automotive event.

Over fifteen Victorian companies from the automotive aftermarket manufacturing industry are either exhibiting or have a presence at the trade show, which offers participants the opportunity to meet with industry leaders and learn the latest industry trends.

Ben Bartlett, Senior Manager Government Relations and International with the Australian Automotive Aftermarket Association, says there are a number of sectors which present real opportunities for Victorian companies.

?We are seeing significant growth in the four wheel drive market, in particular when it comes to suspension,? he said. ?There are challenging off road conditions in the Middle East and there are no more challenging conditions than in Australia, so our companies are able to offer road products that fit the marketplace. There is also strong potential growth in the performance and tuning sectors.?

Craig Mahoney, International Sales and Marketing Manager from Mainline DynoLog Dyamometers, who provide advanced vehicle performance measurement technology, has been visiting Dubai for the past three years around the trade show.

?There is a high respect for Australian made products in this region,? he said. ?We have been here for three years now and we want to keep returning and flying the flag to create strong and long-standing relationships. We come here and we get to know our customers well and also their customers, which we think is very important. It?s led to 90 per cent of our business being based on recommendations.?

First-time exhibitor Toby Dymond, Managing Director of Penrite Oil, a family owned Victorian company with 85 years experience in quality lubricants, said his company is looking for export growth throughout the region.

?Our growth strategy is focused on exports,? he said. ?We manufacture engine oils, transmission fluids, brake fluids, coolants for performance automobiles, trucks and motorcycles and our objective here is to find local distributors.?

Victoria is the home of Australia?s automotive industry, with 54 per cent of the country?s automotive exports coming from the State. Ford, Toyota and Holden all have a large presence in Victoria, along with over 150 Australian, European, Japanese and American component manufacturers.

Movie Review: 'Men in Black 3' Mojo Saves Galaxy Again - Snellville ...

It's been a decade since "Men in Black" last defended the galaxy from bad guys. The world has certainly moved on, but the MIB team has not because it's business as usual in "Men in Black 3."

Agent J (Will Smith) and Agent K (Tommy Lee Jones) continue their exploits, this time with Smith going back in time, to 1969, where he teams up with a younger agent K, played by Josh Brolin, to save the future version of his partner and, of course, the world.

The rest of the film is really all about saving Agent K, saving the world from evil aliens and learning a little bit about the back story of each of our favorite G-Men. It ends with plenty of alien interventions and a nice salute to the fan base who has had an ongoing affection for the MIB universe.

The movie script was not completely done when they started production, shedding light on what many have said is a less than perfect movie. MIB3 is a ?redundant extension of a series that ran out of gas a decade ago, and it doesn?t need a neuralyzer to be forgettable.

The Flick-O-Meter gives "Men in Black 3" a three out of five. It's not as good as "Men In Black" (the original) but superior in almost every way to MIB2. Few things in life are worth waiting a decade for, and this isn?t one of them. But after witnessing so many big-screen sci-fi comebacks go so hideously wrong in recent years, "Men In Black 3" emerges as something of a triumph, of sorts.

AP: Churches to raise money to fight gay marriage

PORTLAND, Maine (AP) ? Scores of Maine churches will pass the collection plate a second time at Sunday services on Father's Day to kick off a fundraising campaign for the lead opposition group to November's ballot question asking voters to legalize same-sex marriages.

Between 150 and 200 churches are expected to raise money for the Protect Marriage Maine political action committee, said Carroll Conley Jr., executive director of the Christian Civic League of Maine evangelical organization and a member of the PAC. Conley is also trying to drum up support for the Maine campaign from religious leaders from around the country.

It's unusual, but not unheard of, for churches to take up collections for political causes. Maine's Catholic diocese says it raised about $80,000 with a designated collection in 2009 in its effort to overturn Maine's same-sex marriage law, which was passed by the Legislature that year and later rejected by voters. The Catholic church isn't actively campaigning this time, instead focusing on teaching parishioners about the sanctity of marriage between a man and a woman Father's Day, June 17, seemed an appropriate time to kick off this year's fundraising campaign because of the day's focus on family, Conley said. Additional collection-plate offerings at churches are expected in the months ahead.

"The messaging we're using is that those who are seeking to redefine marriage in Maine believe there's no difference between moms and dads," Conley told The Associated Press. "We believe those differences are relevant. We don't think the differences in the genders are societally imposed roles, and we believe that children benefit when they're in that ideal environment where there's a mom and dad."

Protect Marriage Maine has been in contact with about 800 churches across the state and expects 150 to 200 to participate in the Father's Day collections, Conley said. They include Methodist, Baptist, Pentecostal, Nazarene, Church of God, Wesleyan, Evangelical Free, Advent Christian and other denominations.

While many churches are joining the campaign against the referendum, others of various denominations are working to support the ballot measure.

Some churches have hosted phone banks where congregation members have made calls in favor of the referendum, said the Rev. Sue Gabrielson, the minister at the Sanford Unitarian Universalist Church. Other churches have held educational forums and training sessions on door-to-door canvassing.

The referendum, she said, is about inclusion, a "loving God" and being nonjudgmental and compassionate.

"What we want is for people to know that this is a religious issue," she said.

Episcopal Bishop Gene Robinson of New Hampshire, who created an international uproar when he became the first openly gay bishop in the Anglican church in 2003, is coming to Maine in early June on behalf of the campaign in support of gay marriage. He will appear at three screenings of the film "Love Free or Die," which depicts his life, in Portland, Lewiston and Ellsworth.

Churches in Maine and elsewhere have raised money from parishioners for political campaigns in the past on issues including gay rights, doctor-assisted suicide, abortion and gambling.

Federal law prohibits churches and other 501(c) (3) charitable organizations from supporting or opposing candidates running for office, either through financial contributions or endorsements, said Brent Walker, executive director of the Baptist Joint Committee for Religious Liberty, a Washington advocacy group that supports separation of church and state.

"But they can, with near impunity, support issues and causes, including same-sex marriage referenda," Walker said.

Supporters of Maine's ballot question have said they expect to raise $5 million or more for their campaign. Opponents have said they expect to raise far less, but collection plate offerings will go a long way toward helping fund the campaign, Conley said.

Conley has been in Washington, D.C., this week at a pastors conference organized by the conservative Family Research Council. There, he met with other gay marriage opponents from Minnesota, Washington and Maryland, where same-sex marriage ballot initiatives are being debated.

Minnesota will decide in November whether a ban on gay marriage should be part of the state constitution. Maryland and Washington are expected to have ballot measures seeking to overturn same-sex marriage laws that were recently passed by their legislatures.

Conley's also seeking endorsements from well-known pastors who might be willing to record video and audio clips that can be played at churches taking part in Maine's collection-plate drive, he said. Those clips would also be sent to the state's Christian radio stations as public service announcements.

Segui could be reluctant witness against Clemens

WASHINGTON (AP) - Former major leaguer David Segui (seh-GEE') is on the verge of having to testify in the Roger Clemens perjury trial, even though he doesn't want to.

Prosecutors want Segui to relate a conservation he had with Clemens' former strength coach, Brian McNamee, in 2001. McNamee supposedly talked to Segui about saving waste from injecting players in order to placate McNamee's wife.

That would be consistent with McNamee's testimony as to when and why he saved evidence after allegedly injecting Clemens with steroids that year.

U.S. District Judge Reggie Walton will rule Thursday whether Segui has to testify. When told Segui doesn't want to, the judge said: "If he doesn't show up, he'll be arrested like anyone else."

Clemens is accused of lying to Congress when he denied using performance-enhancing substances.

[EXCLUSIVE] Chief Public Safety attorney ignores legal opinions ...

As Ohio?s legislature prepares to quietly pass legislation that legally allows the Highway Patrol to operate at the newly privatized prison in Conneaut, Ohio, the bigger story that has generally gone unreported (except by Plunderbund, of course) is the multitude of ways in which the Ohio Department of Public Safety?s legal department has attempted to circumvent existing law.

According to records obtained by Plunderbund, James Canepa, Chief Legal Counsel at Ohio Department of Public Safety, ignored two opinions issued by the Ohio Legislative Service Commission (OLSC) when he pursued an agreement with the City of Conneaut to have the Highway Patrol provide law enforcement and investigative services to Ohio?s newly-privatized prison.

As we?ve been discussing, John Kasich?s decision to sell the Lake Erie Correctional Facility in Conneaut to private prison operator Corrections Corporation of American (CCA) opened up a series of problems for the city and the state, not the least of which was identifying who would investigate crimes at the private facility. The Highway Patrol currently performs this function at state prisons but is forbidden from operating on private property.

In October of last year, realizing LECF would be sold to CCA, state and local officials began scrambling to figure out how to handle this dilemma. ?We have obtained a October 26, 2011 Memorandum from the City of Conneaut?s Law Director Office.? This Memorandum states that in other cities with private correctional facilities owned by CCA, ?the local police generally has the responsibility to conduct criminal investigations inside the facilities . . .?? .

This may seem like an academic point, but it has real world implications for Troopers.? As we noted a little over a month ago, Troopers could face personal liability because they were acting outside of their jurisdiction.? (Of course, Kasich, who views law enforcement officers as idiots, and who tried to strip Troopers of their collective bargaining rights, probably doesn?t care.)

It turns out that others agreed with us long ago.? On October 17, 2012, an opinion issued from OLSC by Attorney David M. Gold identifies the lack of clarity in the new legislation, but clearly points out that existing statutory language ?restricts the Highway Patrol?s authority to facilities ?owned and leased by the state.?? And once ownership of the prison was transferred to CCA, the prison would no longer fall under this authority.

On December 1st, 2011 Bethany Boyd, also an Attorney with OSLC, issued an opinion that cleared up any questions about the Patrol?s authority. According to the second opinion, ?the facility is private property and not state property or a state institution; thus,?the Patrol has no authority to enforce the criminal laws or to undertake major criminal investigations?there.? The opinion also states that ?the Patrol has?no statutory authority to enter into a mutual aid agreement?with local law enforcement agencies in regard to the Lake Erie Correctional Facility.?

Let me restate that in case it wasn?t clear: two different attorneys from OLSC both provided the same opinion regarding the Patrol?s authority to operate on private property i.e. they HAVE NO authority. The second attorney also stated that, without any question, the Patrol can NOT enter into an agreement with local law enforcement agencies to provide these services.

And yet records show that 9 days later, on Friday, December 10th, head lawyer for the Department of Public Safety James Canepa asked Conneaut Law Director David Schroeder to write a letter requesting that the city and local police department enter into an agreement with the Highway Patrol to provide law enforcement services at the prison.

On Monday December 12th, the city?s law director executed the letter and sent copies to Canepa. In an email exchange Canepa asked Schroeder to insert a new paragraph at the end of the letter saying that ?the City of Conneaut authorizes the Ohio State Highway Patrol to conduct?investigative/law enforcement services? and that the ?Highway Patrol?s authority in this regard shall be?the same as that of the Conneaut Police Department.? The letter was updated per Canepa?s request and sent to Colonel John Born of the Highway Patrol and Tom Charles, Director of the Ohio Department of Public Safety.

A draft Memorandum of Understanding between locals and the Patrol was also drawn up in an attempt to help deal with associated insurance issues. According to Law Director Schroeder, the MOU was never executed or signed and the ?matter was resolved in another manner.?

Still, the fact that Canepa asked for any of this in the first place, despite having two distinct legal opinions from two different state lawyers saying the Patrol could not operate at the prison is completely bizarre behavior for the chief legal counsel for Public Safety. It?s his JOB to know what the Highway Patrol can and can?t do. And he should absolutely know that the patrol does NOT have the same legal authority as the city police department.

And if for some reason he had any doubts, the two opinions from OLSC should have given him all the proof he needs that he CAN?T enter into an agreement with the city of Conneaut and he CAN?T let the patrol operate at the private prison. And yet the patrol continues to operate at the prison today.

I have yet to meet a lawyer who has read existing law and thinks the Patrol has any authority at this prison or any other private property.? ?And yet Canepa continued to try to find ways around the law to pursue Kasich?s agenda, going all the way to the AG?s office, a topic we?ll cover in our next post.

This isn?t the first time Canepa has tried to use his position and legal maneuvering to circumvent the rules. As we discussed a fews weeks back,Canepa?s obviously incorrect?legal opinion regarding a grant to the Ohio Association of Chiefs of Police directly resulted in the state paying back nearly $3 million is misappropriated funds.

But the potential dangers associated with this decision could end up being even worse. Instead of just blowing misappropriated federal dollars on big salaries and trips to Turkey, the decision to allow Troopers to operate on private property, outside of their jurisdiction,?put the troopers at risk?of liability for their actions while performing their assigned duties at the prison.

The reasoning behind Canepa?s actions seems pretty clear: John Kasich wanted to sell this prison, and he tasked Canepa and his other appointees at Public Safety to figure out the details. As the the Chief Legal Counsel for Public Safety, Canepa?s primary job is to provide sound legal advice to the department?s leadership, and in this capacity he has absolutely failed.

Moreover his decision to ignore the law, and the legal opinions of other state attorneys, puts rank-and-file Highway Patrol troopers at personal risk. Canepa appears to have put politics and pleasing Kasich ahead of following the law and protecting the hard working Troopers that rely on him. And this is absolutely unacceptable.
